By ticking the ‘Agree to our Terms and Conditions’ box this form you agree that:-

You have the authority to complete on behalf of the Hirer;

The Hirer will Hire the Location on the date(s) and at the rate specified;

Pro Studio Hire’s terms and conditions of business apply to this agreement and in the event of a dispute these terms will prevail.

Terms and Conditions of Business

These are the terms & conditions Pro Studio Hire Ltd. We are company number 13150963 registered in the UK. Our registered office is at The Picture House, 307-315 Holdenhurst Road, Bournemouth, Dorset, BH8 8BX.

Booking

A booking is considered firm after receiving the full payment or pre agreed deposit.

Studio bookings must be paid for at the time of booking.

Setup & Take down time

The client must include set up and take down time within the hours booked, to avoid overtime charges.

Loading-in logistics MUST be fully communicated to studio management prior to arrival to avoid potential issues.

All clients are required to include set-up and take-down/ clean-up time within the hours booked, to avoid overtime/ additional studio time fees being charged. Any unplanned additional studio time will be invoiced and due for immediate payment: the holding deposit will only be released once all outstanding balances have been settled, including overtime and catering.

No materials or equipment must be left outside the hired space (corridors etc).

The studios will be cleaned daily, after 6pm or before 9am.

Leaving the Studio in a reasonable state / Waste / Cleaning / Damage and Repair

All clients, and anyone who attends the studio in association with the client, must leave Pro Studio Hire in a ‘reasonable state’, meaning the studio hired and any communal areas used should be left in the state they were found prior to client occupancy, forgiving standard wear and tear.

Pro Studio Hire reserves the right to charge a reasonable fee for any cleaning above the expected requirements, and/or waste removal required.

Standard waste is inclusive of all bins provided throughout your hired area.

Should you need any additional waste removal (this would be anything above the bins provided as detailed above), waste removal can be arranged, this will be at an additional cost and must be arranged / paid for prior to arrival on site.

The client is responsible throughout the duration of the hire to ensure that no breakages, damages or losses are caused to the property of Pro Studio Hire. This includes maintaining good decorative order and ensuring no alterations to the studio are made without prior consent in writing for changes required for the purposes of hire.

All equipment used, either own or hired, is used at the risk of the client. Pro Studio Hire will not be liable for any loss or damages to materials, props, or equipment except where such loss or damage is due to the negligence or malicious intent of Pro Studio Hire or any employee or engaged party of theirs.

On arrival, it is the client’s responsibility to document any damages to studio space prior to use and inform the studio management, also to inform them if any equipment is either not in working order or not acceptable. Pro Studio Hire will use their best endeavours to replace such items within 24 hours of notification being sent.

The client may erect signage deemed reasonable by Pro Studio Hire to serve as notifying and directional signage, and for the protection and privacy of the Client and Client’s employees. These may not be permanent fixtures nor use fixings which require repairs to walls once removed. If the client’s alterations are not returned to the original state, costs will be charged to the client.

Minors

Clients must ensure that any minor (under the age of 16) is accompanied by a chaperone. Pro Studio Hire must be informed of any shoots that will have minors on the premises. All local Authority permissions must be verified before the booking can commence.

Soundproofing

Pro Studio Hire does not have a soundstage. Clients are advised to visit the site prior to booking to ascertain that the level is acceptable for their purposes. Pro Studio Hire will endeavour to keep noise from any adjacent workspace or studio to a minimum and ensure louder construction is not carried out outside the studios during the working/hired hours of 9:00–18:00. Please discuss your shoot and sound requirements with management prior to booking.

Use of Studio Equipment

The client may not without the written consent of Pro Studio Hire Ltd

Remove the equipment from the studio premises

Modify or alter or tamper with the equipment in any way

Use the equipment in a manner not recommended by the manufacturer

Allow the equipment to be used by any untrained or unauthorised personnel

Equipment must be returned promptly at the end of the hire period in the original condition

Breakages, Losses & Damages

The client hiring the studio is responsible for all breakages, losses or damages caused to the studio or equipment by him/her, or any other person, during the use of the studio.

All equipment and services supplied by Pro Studio Hire Ltd are entirely at the risk of the client. Pro Studio Hire Ltd shall not be liable for any loss or damage to materials or props or equipment, including consequential loss and loss of profit however caused, arising out of the use or the inability to use the equipment supplied or agreed to be supplied.

No alterations, decorations or additions to the studio are permitted without the written consent of Pro Studio Hire Ltd.

The client shall pay any costs incurred to Pro Studio Hire Ltd arising out of any breach of these conditions.

The client must notify Pro Studio Hire Ltd at the time of supply if the condition of the equipment is not acceptable.

Pro Studio Hire Ltd shall not be liable to the client for any loss, damage, expense, or for any consequential loss (including loss of profit) whatsoever or howsoever arising out of or in connection with any of the following: any damage to or loss of property by the Client or the Clients servants or agents or any third party; any breakdown, stoppage or failure of the facilities and equipment provided in the studio or any other equipment supplied to the client by Pro Studio Hire Ltd.

Access Hours and Overtime

The access hours are specified in the Booking form. The access times cannot be amended unless discussed and agreed with Pro Sudio Hire prior to the date of hire.

The overtime fees are charged as follows:

  • Pre-arranged overtime £70 + VAT per hour

  • Unplanned overtime £100 + VAT per hour

You will be billed for overtime in the event of a team arriving before or leaving after the specified access hours. The overtime fee is an hourly charge and will be incurred as you enter each additional hour. There will be no reduction for use of only part of the hour.

Studio Rules

The studio rules, if available, will be sent to You along with this contract, and will set out specific rules relating to the studio. These rules must be distributed and read by all of Your crew. Breach of these rules may give rise to a claim for damage or misuse during the shoot, and we may stop the hire until the team agrees to adhere to such rules.

Equipment

Storage of equipment and props overnight must be agreed in writing prior to the hire and may carry an additional fee. If the agreement in writing is not obtained before the hire, then an additional charge of our hourly out of hours rate will be added to Your final invoice.

Any equipment or valuables left at the Location are at Your own risk. We are not liable for any loss or damage to equipment whilst at the Property.

Power

There is limited three-phase power (32a) and this must be requested at time of booking. There is ample single phase (16a / 32a) power in all studios.

Should you require an additional generator, this will need to be pre-arranged with Pro Studio Hire and will be at an additional charge.

Drop Offs and Pickups

Prop/Equipment etc drop offs and pickups are not possible before or after the hire date(s) unless agreed with Pro Studio Hire prior to the event.

Additional charges based on the hourly hire rate may be added to the invoice in respect of our time and inconvenience caused by drop offs and pickups.

Your Obligations

You must inform Pro Studio Hire of any changes to the studio walls, cove, flooring or furnishings you wish to make and must obtain Our agreement before any changes are made.

You must reimburse Us forthwith on written demand for any costs or losses sustained or incurred by Us arising directly or indirectly from breach of this contract by You.

Cancellation and booking changes

Studio hire booking times can be changed where available and as discussed and agreed in writing with the studio manager, this will be subject to a Re-Booking Fee:

  • 7 days notice provided: re-booking fee equal to 10% of total booking fee

  • 3 days notice provided: re-booking fee equal to 20% of total booking fee

  • Less than three days notice provided: re-booking fee equal to 30% of total booking fee

Cancellation of studio booking will be subject to the following Cancellation Fees:

  1. 7 days notice provided: cancellation fee equal to 25% of total booking fee.

  2. 3 days notice provided: cancellation fee equal to 50% of total booking fee.

  3. Less than 3 days’ notice provided: cancellation fee equal to 100% of total booking fee.

Noise

Noise levels must be kept to an appropriate level during studio hire. Any requirement for excessive noise levels must be discussed and signed off by Pro Studio Hire Ltd prior to acceptance of booking.

Pre-Visits / Recces

The photography displayed on Our website is intended to give a general overview of the space and style of the Property. The images and description should not be relied upon as an exhaustive list of the contents or current decoration of Pro Studio Hire Ltd. We make no warranty or representation that the studio is fit for purpose. You are advised to visit the Property prior to making the Booking. If no pre-visit is made, no compensation can be requested if the Studio does not meet your requirements.

A recce may be chargeable if its activities are outside that which have been agreed in writing prior to the appointment, or if it exceeds the time allocated for the appointment.

Any room dimensions or measurements requested from Us are for general guidance only and do not form part of the contract. It is Your responsibility to visit and take exact measurements where required.

Paint colours, if requested by You from Us do not form part of the contract.

Insurance / Damages

You must ensure that You have Public Liability Insurance of a minimum of £2,000,000 and a copy of Your current insurance policy document must be made available to Us on request. Any loss or damage to the Studio due to Your negligence is Your responsibility and You accept that You are liable to reimburse Pro Studio Hire Ltd for any direct or indirect loss caused to the Property.

General

Governing Law: this contract and any dispute or claim arising out of or in connection with it or its subject, matter (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales.

Jurisdiction: Each Party irrevocably agrees that the Courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this Contract or its subject matter (including non-contractual disputes or claims).

Termination

Pro Studio Hire Ltd may terminate any hire contract if the client shall be in breach of any of the Terms and Conditions.
